I dont know what to do do i get a lawyer never been hit in a car before what should i do?

Is his insurance covering it?

Do not sign off on any insurance claim for long term disability.

Sign off on the current medical bills and loss of your vehicle.

Issues can pop up years later that are a result of a previous accident. This is why you don't sign off on long term issues.

You should contact your personal insurance agent. They will be more than happy to help.. Especially in going after the other guy since it wasn't your fault.

Look brother get yourself a GOOD lawyer talk to some friends that would know one in your area.

In the next few weeks you'll probable start getting large envolopes with ambualance chaser audition dvd's. When my step dad had his accident, thier lawyer told my mom that even though those guys are mostly nut jobs, these cases are the only ones alot of them deal with. So, if you really want to screw with the guy, sick an amb. chaser on him. If you have your own attorney already, talk them and your insurance prior to doing this. Another thing to consider is they really don't get paid unless you get paid, so your not really out anything.

If he didn't have insurance you'll be dealing with YOUR insurance company... he did have insurance, right?

He did have insurance so thats good and i just got off the phone with the lawyer!!!! woohoo in a year ill get some money !!!!

I'd just worry about getting all the medical bills covered, include the physical therapy bills that you may have for the next 2 years, and then replacement for the car. Any extra is great but I wouldn't set out to ruin the guy's life.

I had a buddy that worked for a construction company, he was the foreman.  They did work on roads and had a lane of two lanes closed down, coned off and everything.  Well one morning this jackass came blasting through the cones, he was late for work or something, and nailed my buddy standing there trying to direct traffic.  He got thrown about 40 ft. and was knocked out cold.  He was hurt but not real bad.  Obviously, he got a lawyer and took this jackass to court.  My buddy won but the only problem was that the lawyer ended up with about 50 percent of the 70,000 settlement.  It also took about 2 years to get his money.  He barely got the medical bills covered and still has some aches to this day.  Just be careful who you get to help you out.  Hope everything turns out well for you.

I've heard from a couple of sources that the going rate for accident lawyer's is 30-40% of the settlement. That's why in most cases, do get the big payday, you about have to bankrupt the other party.

35% is a normal lawyer fee. But you try to settle without a lawyer you will be offered 20% of what they would be willing to pay. Do the math.

They do tend to cough up more when a weasel is involved.

Sorry to hear that man that sucks ass!!! I am not surprised though with the way people drive in SF. It sounds like this accident wasn't your fault so I wouldn't worry about anything. Did you file a police report?

Uh, was the Ambulance running lights and sirens?

If so, you should have been on the side of the road giving the ambulance the right of way...

No need for a lawyer if he has insurance, let them fix the car (or total it and write you a check) and move on.  People that go for un-justified settlements from wrecks piss me off.  If you were well enough to post on BullRun forums, you probably didn't get hurt at all.  By going after "free" money, you're only raising everyones insurance premiums.  Just think how low insurance rates would be if people didn't go after unnecessary settlements from vehicular accidents.

I'm a firm believer in what goes around comes around, accidents happen, next time it could be you at fault with an un-justified settlement requested from the other driver...

Hold on hold on. No one said he was going to rip the driver a new one. He's not out to ruin the guy's life.

Just because he wasn't in a full body cast and on a respirator does not mean he wasn't injured. I have a pianist friend who's wrists are f*cked because a semi ran into the back of his vehicle and the car is considered totalled. He can still use his hands,type etc... but he cannot put certain types of strain on them for long periods of time. Those hands are his life, money maker.

But as has been seen with Nissan Dragger's truck, insurance companies as a general rule UNDER value your vehicle so as not to pay you as much for it being totalled. Some injuries can take a long time to heal and an insurance settlement that seriously under values a vehicle and injuries won't do anyone any good.

Just be smart, dont sign anything without reading it completely. If you dont understand then get help. Stay away from all the tv advertised lawyers, they usally charge the most.

Thanx for all the conncern and i have procured a lawyer 33.3% is the going rate. Feeling much better the last 2 days now that im off the full meds rutine... mri and x-rays are this week then i will know how bad the shoulder is other than that we are still ready to win S3 if i have to remove my arm! Ok maybe not the entire arm but ill get a fancy brace...lol   but now that im not on all the meds i can get out of bed without getting sick woohoo!  R.I.P my mazda mx-6(aka the M-X STRANGE)
